These Terms and Conditions (“Terms”) govern access to and use of the Website OOPS™ AI website, platform, tools, reports, exports, and related services (collectively, the “Service”), operated by Website OOPS™ AI (“Website OOPS,” “Company,” “we,” “us,” or “our”).

By accessing or using the Service, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not use the Service.

Website OOPS™ AI provides automated, informational analysis based solely on publicly accessible website signals to identify general website availability, usability, and technology compatibility observations.

The Service may include:

• Website availability and reachability checks
   
• Mobile-friendliness indicators
   
• Technology compatibility observations
   
• Aggregation of publicly available business listing data
   
• Reports, dashboards, and downloadable exports
   

The Service is observational and informational only.

All outputs, reports, scores, grades, indicators, or findings provided by Website OOPS™ AI are for general informational and business awareness purposes only.

Website OOPS™ AI does not provide:

• Legal advice
   
• Medical advice
   
• Financial advice
   
• Cybersecurity assessments
   
• Regulatory or compliance audits
   

You agree not to rely on the Service as a substitute for professional advice or formal assessments.

Website OOPS™ AI does not create, receive, maintain, transmit, or access:

• Protected Health Information (“PHI”)
   
• Electronic Protected Health Information (“ePHI”)
   
• Patient records or clinical data
   
• Login credentials or internal system data
   
• Non-public Personally Identifiable Information (“PII”)
   

All analysis is strictly limited to publicly accessible content.

Website OOPS™ AI is not a Business Associate under HIPAA, and a Business Associate Agreement (BAA) is not required.

The Service does not constitute:

• A HIPAA compliance review
   
• A security audit or penetration test
   
• A regulatory evaluation
   
• A certification or attestation of compliance
   

You may not represent Website OOPS™ AI outputs as evidence of regulatory violations, legal non-compliance, or security vulnerabilities.

By using the Service, Customer acknowledges and agrees that:

1. No PHI or regulated data is accessed or processed
    
2. Website OOPS™ AI is not a Business Associate under HIPAA
    
3. Customer will not upload, submit, or transmit PHI or sensitive data
    
4. Outputs are informational only and not compliance determinations
    
5. Customer is responsible for lawful and ethical use of the Service
    

Customer agrees to indemnify Website OOPS™ AI for any claims arising from misuse or misrepresentation of outputs.

Website OOPS™ AI makes no guarantees regarding:

• Accuracy
   
• Completeness
   
• Timeliness
   
• Continued availability of findings
   

Website conditions may change at any time. All results represent a point-in-time observation only.

The Service may rely on third-party data sources, including mapping services and business directories.

Website OOPS™ AI is not responsible for:

• Errors or omissions originating from third-party data
   
• Availability or accuracy of third-party services

You may use the Service for:

• Internal analysis
   
• Business development and outreach
   
• Website visibility review
   
• Sales intelligence and reporting
   

You may not:

• Misrepresent outputs as audits or compliance findings
   
• Use the Service to harass, threaten, or defame others
   
• Resell or redistribute reports without authorization
   
• Scrape, reverse engineer, or misuse the platform

All content, software, methodologies, reports, templates, branding, and intellectual property associated with Website OOPS™ AI are the exclusive property of Website OOPS™ AI or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Service subject to these Terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
   
• FITNESS FOR A PARTICULAR PURPOSE
   
• NON-INFRINGEMENT
   

Website OOPS™ AI does not guarantee business outcomes, revenue increases, lead conversion, or search rankings.

To the maximum extent permitted by law, Website OOPS™ AI shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
   
• Loss of revenue, business, or reputation
   

Total aggregate liability shall not exceed fees paid by Customer to Website OOPS™ AI in the twelve (12) months preceding the claim.
